It depends on your policy. Many policies have an incontestability clause, meaning that if you've had the policy for over two years, say, they can't drop you because of a preexisting condition. However, each policy is different and if you intentionally failed to disclose a preexisting condition in your application for health insurance, they could rescind the policy, which has the effect of your never having had the policy in the first place. In such a case all your premium payments should be refunded. A lawyer can tell you pretty quickly if you have a case against the insurance company. Once a lawyer gets involved, the insurance companies tend to pay up pretty quickly to avoid any bad faith judgment which could run into the millions of dollars.
